A list of frequently asked questions for Motions Booklets.
A motion booklet should be indexed, paginated and clearly identifiable in relation to the case. It should include copies of the following:
- the notice of motion
- each affidavit (including exhibits) lodged in support or opposition of the motion
- the notice of appeal and the order under appeal
- the judgment under appeal (or transcript or agreed note of the judgment) if available
- any other document relevant to the motion – if the motion is for an extension of time it must include the originating High Court documents.
If the motion is to be heard on a Monday, you should lodge three booklets by the Wednesday before the hearing date. If it is to be heard on a Friday, you should lodge one copy by the Tuesday before the hearing date.
